Process Overview

Reporting options are available to the RIT community 24/7 either in person or online. In-person reports can be made 24/7 to Public Safety, or to the Title IX Office during business hours. In addition, reports can be made online on the Title IX webpage, or anonymously through the RIT Ethics and Compliance Hotline. For a complete list, check out Reporting Options.

Once a report is made to the university, each report is assessed by the Director of Title IX and Clery Compliance, and in collaboration with a case management assessment team when appropriate. Interim and accommodative measures may be put in place after a risk assessment is conducted. In addition, Public Safety routinely conducts threat assessments as part of their standard operating procedure for all incidents reported to them either directly or through the Title IX Office.

Safety Planning

If a report proceeds to investigation, parties are promptly notified of allegations by the investigating party -- either RIT Public Safety or the RIT Title IX Investigator. Prior to the start of the investigation, a Notice of Investigation and Allegations (NOIA) is sent to both parties.* The NOIA has information about resources and next steps. Potential policy violations are identified in the NOIA, along with any applicable interim measures..
* Non-members may not have access to documentation.

 Title IX Employee Reporting Guide

Public Safety investigates incidents involving student respondents. The Title IX Investigator investigates incidents involving employee respondents. All Title IX investigations are documented. Interviews, statements, and all relevant evidence is compiled into an Investigation Report. Relevant evidence may include: written notes and images, text messages, emails, photos, social media posts, video or audio files, medical reports, receipts, site visits, and any other physical evidence.

Student Cases: Following an investigation, cases involving student respondents are referred to the Center for Student Conduct and Conflict Resolution. Student Conduct will determine the appropriate nest steps, which may include a formal hearing or a mutual resolution agreement. If a case proceeds to a hearing, then hearing officers are assigned to hear and determine the outcome of a case. The hearing officers will decide whether the respondent is responsible for violating RIT policy. If the respondent is found responsible, the hearing officers will also determine the appropriate conditions and sanctions (statuses) for the responsible party.

Employee Cases: Following an investigation for a C06.0 allegation(s), the Title IX Office will send a complete Investigation Report to Human Resources. Human Resources reviews the case and makes determinations regarding whether the respondent is responsible for violating RIT Policy. If found responsible for a policy violation, Human Resources then makes recommendations to senior leadership regarding the appropriate corrective action. Following an investigation for a C27.0 allegation(s), the Title IX Office will send a complete Investigation Report to Human Resources. Human Resources reviews the case and makes a determination regarding whether a formal hearing or mutual resolution agreement is appropriate. If a case proceeds to hearing, then hearing officers are assigned. The hearing officers will decide whether the respondent is responsible for violating RIT policy. If the Respondent is found responsible, the hearing officers will also determine the appropriate conditions and sanctions (statuses) for the responsible party.

Student Cases: Both parties have the right to appeal the final outcome of a Title IX case. Upon appeal, the Associate Vice President for Student Affairs will determine whether the individual appealing has satisfied the grounds for appeal, and then schedules the appeal. An appeal board, University Appeal Board, is convened for hear the appeal. The outcome of an appeal is final.

Employee Cases: Both parties have the right to appeal the final outcome of a Title IX case under Policy C.27 only. Appeals are made to the Vice President and Associate Provost for Diversity and Inclusion. Should there be a conflict with the VP and Associate Provost for Diversity and Inclusion an appeal committee will be convened. The outcome of an appeal is final.

There is no appeal in employee cases for any other policy, including Policy C06.0.
